The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the introduction of a new comprehensive peace framework for ending the war appeared – briefly – to have been contained. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: a renewed assault of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the harsh reality of the outgoing year. By day, negotiation efforts are conducted: positive announcements are delivered from different nations. Significant resources is expended on restraining certain initiatives. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the present situation of Ukraine's defenselessness was laid bare. Ukraine is equipped to monitor projectile deployments from Russian territory, a capability enabled by timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to intercept incoming cruise missiles flew past – sophisticated military planes delivered to Ukraine by European allies.

Moments later, Kyiv's air-defence systems activated: multiple launches deployed against a incoming threat. This was a modern interception technology at work, probably supplied through partner states. Every deployment creates sudden vibrations, shaking the windows. The brief panic quickly gives way to grim resignation: perhaps the incoming missile won't cause damage this time, protecting urban areas from ruin and additional electricity failures.

Continuous Dangers

Soon after, a automatic firearm opened up on a unmanned aircraft close by, part of a rapid response unit – most likely imported technology. Sadly, the bullets missed the opposing UAV – it pressed on overhead toward its objective.

Periodically, this persisted until dawn. Kyiv awoke to the early updates: seven people killed, destruction and infrastructure problems in many homes as a result of the nocturnal offensive. As always, everyone still continued their routines – enduring hostilities. But those 24 hours demonstrated Ukraine's essential dependence on international aid – a dependence that regional partners are clearly incapable to replace in the near term.

Failed Diplomacy

The 28-point plan from US administration generated strong feelings, discussion and serious worry – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and bilateral conferences.

Every new initiative from US leadership unfolds according to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually secure success. This trend will, undoubtedly, endure.

Strategic Calculations

It is convenient to criticize particular leaders of persistently promoting Russian terms. But that does not seem to be the complete picture. American leadership works based on a premise understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The White House believes that it is unfeasible to compel Moscow to abandon the territory that it already controls in Ukraine's south or east.

The challenge is that while recognising this factual reality, Washington does nothing to prevent Kremlin actions, through words or deeds, from thinking that the current condition will not shift further in its advantage in the months ahead.

Divergent Views

Therefore, Russian leadership is certain that the clock favors them – that Ukraine and its supporters are coming close to fatigue. Their reason to sign a deal that does not give them the largest achievable advantage is close to zero. There may be numerous efforts to end hostilities, but they will carry on as long as Russia's leader remains supremely confident in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing lives and land but averting a total frontline collapse until situations evolve in its favour.

Existing Situation

Realistically, there are no actual prerequisites for a truce. Now, personal considerations are entering the equation: political desires to mediate resolution and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unacceptable, so that their priority does not shift toward internal issues. And although their mission will now be significantly challenging after latest incidents, it remains very improbable that this will modify their basic position.

These two forces are guiding negotiations.

Summary and Prospects

It took a just a single week to terminate the suggested clauses of the most recent proposal. Aggressive and erratic handling of the matter by Washington, opposition by Ukraine and the other European countries, along with calming attempts of representatives, and finally, recent disclosures, all served their function.

While new initiatives based on previous concepts are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and show certain reluctance to alter the situation, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, primarily depend on continued Western support.
